For over 20 years, we’ve advised sellers not to pay a fee in advance to list a time share for sale. A company that asks you for money before they’ve sold your unit is more interested in getting the listing than making a sale. They'll promise a fast sale at a high price because every listing they take is money in the bank.
Real estate brokers committed to selling will never ask you to pay for services in advance. We recommend you do not pay a fee, including a “refundable” fee, to list or advertise your time share.
And NEVER, EVER, EVER pay a company money to "get rid of" your timeshare without talking to us first!!! There are a lot of scams out there, but this one takes the cake! There are several companies currently making the rounds in Arizona and many other states. You are invited by mail to a presentation at which they are supposedly going to make an "offer" on your timeshare. After listening to a presentation about there being no way to sell a timeshare, no way to end your obligation to pay maintenance fees without losing YOUR HOUSE, and instilling the fear that you are going to pass the obligation to pay maintenance fees FOREVER on to your children, the "offer" is that this company will let you transfer title to them provided YOU pay THEM the paltry sum of $2,495.00 People, if you have been invited to a presentation like this and are actually willing to pay someone take your timeshare off your hands, please call us! You've been targeted because you own at least one timeshare that has some resale value. There are better solutions, and we'll be glad to share them with you.
Here's the low down on some of the other "come-ons" to watch out for! Advertising companies will offer to sell your property with no commission, just an upfront fee to advertise. They are advertising companies with no legal authority to negotiate on your behalf, write a contract, or assist in any way with the mechanics of selling your time share. And they will tell you anything you want to hear about the value of your ownership...they're in the business of selling advertising, not timeshares.
In addition, you do not need an appraisal to list, sell, or finance your week. Think about it. In residential real estate, an appraisal is typically required by a LENDER to whom you've applied for a mortgage, not by the BROKER before he even lists your home for sale. A lender, most likely a bank or mortgage company, requires an appraisal because the property will serve as collateral for the loan and they need to know that, if the buyer defaults, the value of the property is sufficient for them to recover the balance on the loan. If you're talking to a broker who can't give you an idea of the market value of your property without insisting you pay for an appraisal, find another broker!
Also beware of "investment trusts" that offer to purchase your unit at its appraised value. These companies claim they do not perform appraisals, but they require you to obtain one. Can you use an appraiser you find in the yellow pages? No! You probably can't even use an appraiser in the town where your resort is located. You have to use an appraiser approved by the "investment trust" who they will have contact you! We have many clients who have paid as much as $400 for an appraisal only to be offered 10% of the appraised value by these groups.
The bottom line is this. Timeshare appraisals didn't exist until some states made it illegal for brokers to charge an upfront listing fee. The brokers who formerly charged upfront fees had to stop collecting them. Now they don't charge you a listing fee...they just make you pay for an appraisal.
Timeshares sell on the resale market for much less than the price a developer can obtain. That makes any seller with an urgent need to dispose of a unit easy prey for the unscrupulous. A resale company that charges money on the front end can promise a fast sale and high price because they don't have to sell timeshares to stay in business. They only have to get people to list...easy to do when you don't have to sell anything, just make promises.
Over the years we have talked with thousands of sellers who have been victimized by upfront-fee companies, many who were already dealing with difficult situations...major illness, loss of a job, and loss of a partner through divorce or death. We think taking advantage of people when they are most vulnerable is just plain wrong. It is, however, very lucrative. Quite frankly, if we could work that way and still sleep at night, we might be tempted. Call us hopelessly old-fashioned, but we still believe that providing a valuable service at a reasonable cost is the only way to earn a living.
